Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Garchi CMS website and API services (the "Service") operated by LumenHarbor Digital Solutions Limited

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access the Service.

“SaaS” refers to Software as a Service.

If you have any questions or require clarification, please contact us at admin@garchi.co.uk.

By registering for an account, you confirm that you have read, understood, and agree to be bound by these Terms and any consequences of non-compliance.

1. Account Usage

To access certain features of the Service, you must register for an account. When doing so, you agree to provide accurate, current, and complete information.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. You may not share or transfer your account to any other individual.

You must comply with our Acceptable Use Policy and all applicable local, national, and international laws and regulations when using the Service.

We reserve the right to suspend or terminate your account if you breach these Terms or misuse the Service.

2. Content and Data

  • You retain full ownership of all content and data you upload or store through the Service.

  • You grant us a worldwide, limited license to access, store, and use your content and data solely to the extent necessary to provide the Service.

  • While we implement industry-standard security measures, we cannot guarantee the absolute security of your data. You are responsible for backing up your content and data.

  • Do not expose your API keys publicly. Always use secure, server-side logic to handle API interactions. Your API key is linked to billing and must be stored securely.

  • If you become aware of unauthorized access to your account or data, notify us immediately at admin@garchi.co.uk.

3. Subscriptions and Payments

  • Upon account creation, you will automatically be enrolled in our free plan.

  • We reserve the right to change pricing or benefits of any subscription plan. You will receive advance notice of any such changes.

  • Paid plans are billed monthly. Charges will be applied to your card or bank account at the time of subscription.

  • We use Stripe for payment processing. While payment details are collected via our website, actual transactions are securely processed by Stripe.

  • All charges are non-refundable.

  • You may upgrade or change your subscription at any time. Changes take effect immediately from the date of modification.
Example: If you subscribe on 1st January and upgrade on 15th January, the new plan will take effect from 15th January.

4. Transactions on Your Own Websites and Applications

Garchi CMS provides content management and API services that allow you to create, manage and deliver structured content to your websites and applications.

Garchi CMS does not provide checkout, order management or payment processing for transactions between you and your customers or end users.

You are responsible for managing those transactions, including payments, refunds, cancellations and any applicable consumer obligations, through your own systems or third-party providers.

This section does not affect payments, refunds or cancellations relating to your Garchi CMS subscriptions and add-ons, which are governed by Section 3 of these Terms.

  • You must comply with all sections outlined in these Terms.

  • If you breach any of these Terms, we reserve the right to delete your account with prior notice, where applicable.

  • This Agreement is governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English and Welsh courts.

  • We reserve the right to amend these Terms at any time. You will be notified of significant changes.
